Terms of Service

        Plain-language summary: Use Avalon Heroes fairly, don't misuse it, and understand
        that it's a work-in-progress. Teachers are responsible for appropriate use within their classrooms.
      

1. Acceptance of Terms

By accessing or using Avalon Heroes (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a school or organisation, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility

Teachers / Educators: Must be 18 years of age or older to create an account.
Students (direct accounts): Must be 13 years of age or older. We require age verification at sign-up.
Students (under 13): May only participate through a teacher-managed session. Direct account creation is not permitted for users under 13.

If we discover an account has been created in violation of these age requirements, we reserve the right to terminate it immediately.

3. Educator Responsibilities

Teachers using Avalon Heroes in a classroom setting agree to:

Ensure use complies with their school's acceptable use policy.
Obtain any required parental consent before involving students under 13.
Supervise student use of the Service during school sessions.
Not share teacher credentials with students.
Report any misuse or safety concerns to us promptly.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws.
Upload or share content that is harmful, offensive, discriminatory, or violates third-party rights.
Attempt to gain unauthorised access to other accounts or backend systems.
Reverse-engineer, decompile, or attempt to extract source code from the Service.
Use the Service to transmit spam, malware, or other disruptive content.
Impersonate any person, teacher, or institution.
Scrape or collect data from the Service using automated means.

5. User Content

Teachers may create quizzes and other educational content ("User Content") through the Service. You retain ownership of your User Content. By uploading it, you grant us a limited licence to store, display, and use it solely to operate the Service.

You are solely responsible for ensuring your User Content does not infringe third-party intellectual property rights or violate applicable laws.

6. Intellectual Property & Third-Party Assets

Avalon Heroes is built using a combination of original work and licensed third-party assets. The following applies to each category:

Original work by Avalon Studios:

All visual effects, particle systems, and UI animations created for this project
Game design, level layouts, quiz mechanics, and educational systems
Website code, dashboard interfaces, and branding
Any other content not listed under third-party assets below

Original content is the property of Avalon Studios and may not be reproduced, distributed, or used to create derivative works without prior written permission.

Third-party licensed assets — KayKit:

Character models, environment assets, and certain game art are sourced from KayKit by Kay Lousberg, used under their applicable licence terms. These assets remain the intellectual property of their respective creator and are not owned by Avalon Studios. You may not extract, redistribute, or reuse KayKit assets from this Service outside of the terms of KayKit's original licence.

Other open-source or licensed dependencies:

Authentication is provided by Netlify Identity — see Netlify's Terms.
The game engine (Godot) is used under the MIT licence.
Any additional fonts, icons, or libraries used in the project are subject to their respective licences.

7. Beta / In-Development Service

        Avalon Heroes is currently in active development. Features may change, be removed,
        or be temporarily unavailable. We make no guarantees of uptime, data persistence, or feature stability
        during this phase. We recommend teachers do not rely solely on this Service for critical assessments.
      

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVALON STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, at our discretion and without prior notice. You may delete your account at any time by contacting us.

11. Changes to Terms

We may update these Terms as the Service evolves. We will notify registered teachers via email of material changes. Continued use after notice constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of your jurisdiction, without regard to conflict of law provisions.
